• Exclusive Photographic Services: The Studio/Photographer is under an exclusive contract to provide the specific photographic services as outlined in this Contract.

• Reservation and Refund Policy: Upon consenting to these terms, the Studio/Photographer shall secure the specified date and time. All sitting fees and retainers are non-refundable, barring the Studio's ability to replace the canceled reservation. This exception does not apply in cases of inclement weather. Regardless of any rescheduling or cancellation, fees remain non-refundable.

• Adverse Conditions and Alternatives: In instances where adverse weather or conditions hinder the creation of a portrait meeting the studio/photographer's artistic standards, the Photographer may opt for alternative locations or rescheduling.

• Delivery of Orders and Payment: No part of an order, including previews, shall be delivered or showcased until the full balance is settled.

• Raw Image Files and Edits: Clients acknowledge that they will not receive RAW image files. Image galleries are downloadable for 30 days post-delivery, and any necessary edits must be communicated within this period.

• Payment Terms and Deposits: Payments made online upon booking are non-refundable. Deposits can be rescheduled with a 48-hour notice from the scheduled appointment via telephone during standard business hours at 941.378.3900. Failure to notify the Photographer within this timeframe will result in the forfeiture of the deposit/payment without exceptions.

• Additionally: In the event of rescheduling for the second time, full payment is required upfront. Any subsequent rescheduling attempts will incur additional fees amounting to 15% of the total shoot cost.

• Definition of Headshots: Headshots are defined as images predominantly focusing on the client's head, cropped from above the head to the chest area, inclusive of shoulders, as detailed on the website www.SRQHeadshots.com. They do not encompass 3/4 or full-length photographs.

• Photographer's Discretion and Client Satisfaction: The Client acknowledges hiring the Photographer based on the Photographer's discretion and style. The Client lacks authority to dictate the photography process or rescind this Agreement due to dissatisfaction with the Photographer's work. The Photographer retains the right to select images for client presentation and may remove undesirable images. While efforts will be made to meet the client's preferences, the subjective nature of photography precludes any guarantee of specific outcomes.

• Usage Rights of Images: The Studio/Photographer retains the rights to use session images in their portfolio or social media at their discretion.

• Liability and Contractual Fulfillment: In instances where the Studio/Photographer cannot fulfill the Contract due to uncontrollable circumstances such as fire, casualty, act of God, or Photographer's illness/emergency, the Photographer will refund any deposit or sitting fee without further liability. This limitation also covers damage or loss of photographic materials without Photographer fault. Failure to perform for any other reason shall not hold the Studio/Photographer liable beyond the funds paid.

• Pricing and Modifications: Charges outlined in this Contract are based on the Studio’s/Photographer’s Standard Price List. Future orders will be billed according to prevailing prices at the time of order placement.

• Governing Laws and Amendments: This Contract constitutes the entire agreement between the parties and is governed by Sarasota, Sarasota County, Florida, USA laws. Any modifications to this Contract must be in writing and duly signed by both parties.
